Field Wizard — Terms of Service

These terms govern your use of Field Wizard, a field-service data platform operated at gofieldwizard.com ("Field Wizard", "we", "us"). By creating an account or using the service, you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to bind it.
1. What the service is
Field Wizard is software for contractors and field-service businesses. It lets you build forms, schedule and dispatch jobs, capture data and photos in the field, manage customers and inventory, and produce estimates and invoices.
It is a business tool, sold business-to-business. It is not for personal or household use, and it is not a substitute for professional legal, accounting, tax, safety, or engineering advice.
2. Your account
- You must give accurate information and keep it current.
- You are responsible for keeping your credentials secure and for everything
done under your account.
- You are responsible for the accounts you create for your team, and for
assigning them roles appropriate to their job.
- You must be at least 18 and able to enter a binding contract.
- Tell us at security@gofieldwizard.com promptly if you suspect unauthorized
access.
2.1 One login, one person
A login is for one person. We licence and price Field Wizard per seat, so sharing a single set of credentials across several people is not permitted.
In normal use one person signs in from up to three devices — typically a phone, a tablet and a computer. We record which devices each login is used from so we can tell ordinary use from a shared password.
We would rather fix this with a conversation than a lockout. Going over three devices does not disable anything and will not interrupt work in the field: a borrowed tablet, a replaced phone, or a technician covering a shift are all normal and none of them are treated as abuse. If a login shows sustained use well beyond what one person could plausibly be doing, we will contact the account owner to add the seats that use requires, and we reserve the right to suspend a login only where sharing is deliberate and substantial and the account owner has declined to resolve it.
Note on account security: multi-factor authentication is not available in Field Wizard yet (see our security overview). Until it is, use a strong, unique password and a password manager.
3. Your data
You own your data. Everything you put into Field Wizard — your customers, jobs, forms, submissions, photos, invoices — remains yours. We claim no ownership.
You grant us a limited licence to store, process, transmit, and display that data solely to provide the service to you, and to make backups. That licence ends when you delete the data or close your account.
You are responsible for the data you enter: that you have the right to collect it, that collecting it complies with the law, and that you have any consents your own customers are owed. Where your data includes personal information about your customers, you are the controller and we are the processor — see our Privacy Policy.
You can leave whenever you want. A full export of your entire dataset, in CSV and JSON, is built into the product. One action, no fee, no waiting period, no support ticket. We consider this a commitment, not a feature.
4. Subscriptions and payment
4.1 Plans and billing
- Field Wizard is sold per seat, billed monthly, quarterly or annually in advance.
- Subscriptions renew automatically at the end of each period until you
cancel.
- We charge the payment method on file. Payments are processed by Stripe; we
never see or store your card number.
- Prices are in US dollars and exclude any applicable taxes.
4.2 Changing your plan
Upgrade at any time — you are charged the prorated difference immediately. Downgrade at any time — it takes effect at the next renewal. Adding seats mid-period is prorated.
4.3 Price changes
We may change prices with at least 30 days' email notice before the change applies to your renewal. If you do not accept the new price, cancel before the renewal date.
4.4 Cancellation
Cancel any time. Your subscription runs to the end of the paid period, and does not renew.
4.5 Refunds
Subscription fees are generally non-refundable, and we do not refund partial periods. Two exceptions:
- Annual plans: cancel within 30 days of the first payment for a full refund.
- If we materially fail to provide the service, we will refund fairly.
If we terminate your account for a breach of these terms, no refund is due.
4.6 Failed payments
We retry and email you first. A failed payment does not delete your data. If it stays unpaid, the account moves to read-only — and you can still log in and export everything. Data retention after non-payment is set out in our data-retention schedule.
4.7 Trials
Free trials give full access for the stated period. Note that trial expiry is not currently enforced automatically; that does not create an entitlement to free service, and we may enable enforcement at any time with notice.
5. Acceptable use
Do not:
- Break the law, or help anyone else do so.
- Upload malware, or anything designed to damage or interfere with the service.
- Try to access another customer's account or data, probe our systems, or work
around authentication, rate limits, or role permissions. (Good-faith security research is welcome — see §5.1.)
- Scrape, spider, or bulk-extract data other than through your own account's
export and API.
- Resell, sublicense, or white-label the service without a written agreement.
- Use it to send spam, or to send SMS or email to people who have not consented.
If you use the SMS or email features, complying with TCPA, CAN-SPAM, and equivalent laws is your responsibility.
- Upload material that infringes someone else's rights.
- Store data categories the product is not designed for. Field Wizard is not
HIPAA-compliant and must not be used for protected health information. It is not PCI-certified for cardholder data — payment card details belong at Stripe, not in a form field.
- Deliberately overload the service, or evade rate limits.
- Share one login between multiple people to avoid paying for seats.
We may suspend an account that is actively harming the service or other customers, and we will tell you why.
5.1 Security research
We welcome good-faith vulnerability reports at security@gofieldwizard.com. We will not pursue action against researchers who avoid privacy violations and service degradation, do not access data belonging to others beyond what is minimally necessary to demonstrate an issue, and give us reasonable time to fix it before disclosing.
6. Availability
We work to keep Field Wizard available and reliable, but:
- There is no uptime SLA on standard plans. If you need a contractual uptime
commitment, contact us about an enterprise agreement.
- We may take the service down for maintenance. We will give notice for planned
maintenance where we can.
- Parts of the service depend on third parties (hosting, database, email, SMS,
payments). Their outages can become ours.
- Offline form-filling is designed to let field crews keep working without
signal, with submissions syncing when connectivity returns. It is not a guarantee against every possible device failure — keep it in mind for irreplaceable records.
7. Third-party integrations
Optional integrations (QuickBooks, Stripe, Twilio, the AI assistant, and others) require you to connect your own accounts with those providers. Your use of them is governed by their terms, not ours. We are not responsible for what they do, for their availability, or for data you send them. You can disconnect any integration at any time.
AI output. The AI assistant produces suggestions, not advice. It can be wrong. Check anything that matters before you rely on it — especially numbers on an invoice, an estimate, or a safety record.
8. Intellectual property
We own Field Wizard: the software, design, documentation, and trademarks. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your subscription is active — nothing more.
You may not copy, modify, reverse engineer, or create derivative works of the software, except where the law says you may regardless of this clause.
If you send us feedback or suggestions, we may use them without obligation or compensation. That does not give us any rights in your data.
9. Confidentiality
Each side agrees to protect the other's confidential information and use it only for the purposes of this agreement. Your business data is your confidential information. Non-public details of our systems and pricing are ours. This does not cover information that is already public, independently developed, or that must be disclosed by law.
10. Warranty disclaimer
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or secure against every threat, or that any defect will be corrected.
Some states do not allow these exclusions, so parts of this section may not apply to you.
11. Limitation of liability
To the maximum extent the law allows:
- Neither party is liable for indirect, incidental, special, consequential, or
punitive damages, or for lost profits, revenue, data, or business opportunities — even if warned they were possible.
- **Our total liability for any claim is limited to the amount you paid us in
the 12 months before the event giving rise to the claim.**
These limits do not apply to a party's gross negligence, wilful misconduct, or fraud, or to your obligation to pay fees.
This is a real allocation of risk, and it is reflected in the price. Field Wizard is priced as software, not as insurance. If your operation needs coverage beyond this cap, carry your own insurance or talk to us about an enterprise agreement.
12. Indemnification
You will defend and indemnify us against third-party claims arising from your data, your use of the service in breach of these terms, or your violation of law or of someone else's rights. We will tell you promptly about any such claim and let you control the defence, and we will cooperate.
13. Termination
You may cancel any time, from the app or by emailing support@gofieldwizard.com.
We may suspend or terminate your account if you materially breach these terms and do not fix it within 30 days of written notice; immediately if you break the law, harm the service, or fail to pay after notice; or on 90 days' notice if we discontinue the service entirely — with a prorated refund of the unused prepaid period.
On termination, whatever the cause: you can export your data before it is deleted, and we will tell you the deadline. Data handling after termination is set out in our data-retention schedule.
Sections that by their nature should survive — data ownership, IP, confidentiality, warranty disclaimer, liability limits, indemnification, and governing law — survive termination.
14. Changes to these terms
We may update these terms. For material changes we will give at least 30 days' email notice to account holders. Continuing to use the service after the effective date means you accept the new terms. If you do not accept them, cancel before that date and we will refund any unused prepaid period.
15. General
- Entire agreement: these terms, plus the Privacy Policy and any signed
order form or enterprise agreement, are the whole agreement between us.
- Order of precedence: a signed enterprise agreement overrides these terms
where they conflict.
- Severability: if a provision is unenforceable, the rest stands.
- No waiver: not enforcing a provision once does not waive it.
- Assignment: you may not assign these terms without our written consent. We
may assign them in a merger or sale of the business.
- Force majeure: neither party is liable for delays caused by events outside
its reasonable control.
- Notices: to you at your account email; to us at
